<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2007-083 <br /> <br />(3025) <br /> <br />RESOLUTION ADOPTING A MITIGATED NEGATIVE DECLARATION FOR THE <br />BAY TRAIL SLOUGH BRIDGE PROJECT, PROJECT NO. 144-36-012, <br />AS COMPLETE AND IN COMPLIANCE WITH THE <br />CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) <br /> <br />WHEREAS, construction of a new pedestrian/bicycle bridge and trail is necessary to <br />connect the Oyster Bay Regional Shoreline, owned by East Bay Regional Park District and <br />located within the City of San Leandro, with recently constructed Bay Trail facilities that are <br />located to the north on property owned by the Port of Oakland; and <br /> <br />WHEREAS, a grant from Transportation Equity Act: A Legacy for Users (TEA-LU) <br />Reauthorization ($528,000) is secured; and <br /> <br />WHEREAS, a grant from the Metropolitan Transportation Commission Regional Bicycle <br />and Pedestrian Program (RBPP) is pending; and <br /> <br />WHEREAS, a grant agreement with ACTIA will provide partial funding for the <br />construction of the project; and <br /> <br />WHEREAS, on February 4,2004 by Resolution No. 2004-021, the City Council <br />approved a grant agreement with the Association of Bay Area Governments (ABAG) to provide <br />design services for the subject project; and <br /> <br />WHEREAS, on July 19, 2004 by Resolution No. 2004-119, the City Council approved a <br />contractual services agreement with Mark Thomas & Company, Inc. to provide design services <br />for the subject project; and <br /> <br />WHEREAS, on July 19, 2004 by Resolution No. 2004-119, the City Council approved a <br />contractual services agreement with Mark Thomas & Company, Inc. to provide design services <br />for the subj ect proj ect; and <br /> <br />WHEREAS, The Notice of Intent to Adopt a Mitigated Negative Declaration was <br />circulated for a 30-day review and comment period from May 9,2007 to June 7, 2007. No <br />comments were received during this period; and <br /> <br />WHEREAS, the office of the Engineering and Transportation Department of the City of <br />San Leandro is located at 835 East 14th Street, San Leandro, California, and said Department is <br />the custodian of the documents or other materials forming the basis for this determination. <br />
