<br />Amend Sidewalk Administrative Code <br /> <br />2 <br /> <br />July 2, 2007 <br /> <br />street tree planting. Street tree planting can be encouraged by removing the burden of sidewalk <br />repair from the property owner if the City takes responsibility for the repair, but funding all the <br />repairs with City funds reduces the number of locations that can be repaired each year and can <br />create a backlog. Since 1986, these issues have been balanced by sharing the cost of sidewalk <br />repair due to street tree damage. The current Administrative Code sets the percentage paid by <br />the property owner at 20%, leaving 80% to be paid by the City. <br /> <br />This fiscal year, the budget for sidewalk repairs was sufficient only to cover repair requests <br />received through February 2007. All requests for repairs received after March 1, 2007 will <br />remain on a waiting list until next fiscal year when more funds are allocated to the program. <br />Changing the percentage paid by the property owner to 50% will allow the City to participate in <br />60% more repairs and will reduce the number of repair requests on the waiting list. <br /> <br />Current City Council Policy <br /> <br />Not Applicable <br /> <br />Previous City Council Action(s) <br /> <br />. In 1986, Section 5.5.120 of the Administrative Code set the proportion for sharing the cost of <br />repair of sidewalk damage due to street trees at 1: 1 (50% property owner and 50% City) <br />. On June 2, 2003 by Resolution No. 2003-125, the City Council amended Title 5 Chapter 5 of <br />the Administrative Code changing the proportion for sharing the cost to repair sidewalk <br />damage due to street trees to 80% City and 20% property owner <br />. On November 21,2005 by Resolution No. 2005-156, Title 5, Chapter 5, was renumbered to <br />be Title 8, Chapter 1 <br /> <br />City Council Committee Review and Action <br /> <br />.
