Marian Handa, City Clerk
June 12, 2007
Page 3

of that neighborhood by providing groceries and a small amount of household items for the
convenience of the neighborhood residents. Grocery Outlet will provide these grocery goods
within easy access of neighborhood residents. In doing so, Grocery Outlet will enrich both the
neighborhood and the City by reducing the drive time necessary for neighborhood residents to
obtain both typical and specialty grocery items. This will reduce both the traffic and emissions
generated by neighborhood residents who would otherwise have to drive farther to satisfy their
grocery needs.

As the above demonstrates, Grocery Outlet is a neighborhood grocery store and,
therefore, is a permitted use which does not need planning entitlements. Because the
Moratorium exempts such projects from its scope, we request that the City issue the building
permits necessary for Grocery Outlet to rearrange shelves and install the coolers within the store
in order to open and begin serving the needs of neighborhood residents.

We request that the San Leandro City Council overturn the Board of Zoning Adjustments
and Zoning Enforcement Official's decision and permit the Grocery Outlet neighborhood
grocery store to obtain its tenant improvement building permits and pursue the steps necessary to
open for business.

Sincerely,

\)

-c::~

--~

Michael H.
