Because the
Moratorium exempts such projects from its scope, we requested the City issue the building
permits necessary for Grocery Outlet to rearrange shelves and install the coolers within the store
in order to open and begin serving the needs of neighborhood residents.

The above notwithstanding, we have received letters from Debbie Poll art, Planning
Manager and William Schock, lEO from the City's Community Development Department, in
which our request was denied, stating that the Grocery Outlet is a supc:rmarket because it is over
10.000 square feet. Given that the there is no maximum size requirement for a neighborhood
grocery store, we disagree. We therefore request that the Board of Zoning Adjustments overturn
the Zoning Enforcement Official's decision and permit the Grocery Outlet Neighborhood
Grocery store to proceed.

Sincerely,

~~~~.,
Marc .
Vice President of Real Estate
Grocery Outlet Inc.
Michael H.
