Assessor's Parcel Number 77-540-9; <br />Grocery Outlet, Inc. and Norcal AI, LLC (applicants and property owner); CD <br />Commercial Downtown District. <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />SUMMARY AND RECOMMENDATION <br /> <br />The applicants are proposing that their appli:ation for a Grocery Outlet at 1550 E. 14th Street is a <br />neighborhood grocery store and a permitted use in the CD Commercial Downtown District. The <br />Planning Manager and then the Zoning Enforcement Official have both determined that the <br />proposed Grocery Outlet would be considered a supermarket, which requires a Conditional Use <br />Permit in the Commercial Downtown (CD) District. A Conditional Use Permit for this site, <br />identified as an opportunity site in the Downtown Transit-Oriented Development (TOD) Strategy, <br />would be subject to the existing moratorium related to discretionary action on any opportunity site. <br />The moratorium extends until November 6, 2007, or finalization and implementation of the <br />Downtown TOD Strategy, whichever comes first. <br /> <br />Staff recommends that the Board of Zoning Adjustments deny the appeal (PLN2007-00029) and <br />uphold the determination of the Zoning Enforcement Official that a Grocery Outlet is a supermarket <br />not a neighborhood grocery store. If the Board of Zoning Adjustments denies the appeal, the <br />appellant may appeal the decision of the Board of Zoning Adjustments to the City Council within <br />15 days. <br /> <br />APPLICANTS' SUPPORTING STATEMENT <br /> <br />The applicants assert that the proposed Grocery Outlet is a neighborhood grocery store at the old <br />Albertsons site. They state that, due to its small size of25,000 square feet, with the current industry <br />standard for supermarkets of 70,000 square feet, the Grocery Outlet store is more in keeping with <br />the neighborhood grocery store.
