City of San Leandro
Community D~velopment Department
Planning Services Division
Staff Report

DATE:

June 7, 2007

TO:

Board of Zoning Adjustments ' !)} W.';'/-
i\/\~ ~
Kathleen Livermore, Interim Planning Mana~"

PLN2007-00029; Appeal of the administrative decision of the Zoning Enforcement
Official with regard to the determination that the proposed Grocery Outlet is a
supermarket, not a neighborhood grocery store. Assessor's Parcel Number 77-540-9;
Grocery Outlet, Inc. and Norcal AI, LLC (applicants and property owner); CD
Commercial Downtown District.

FROM:

SUBJECT:

SUMMARY AND RECOMMENDATION

The applicants are proposing that their appli:ation for a Grocery Outlet at 1550 E. 14th Street is a
neighborhood grocery store and a permitted use in the CD Commercial Downtown District. The
Planning Manager and then the Zoning Enforcement Official have both determined that the
proposed Grocery Outlet would be considered a supermarket, which requires a Conditional Use
Permit in the Commercial Downtown (CD) District. A Conditional Use Permit for this site,
identified as an opportunity site in the Downtown Transit-Oriented Development (TOD) Strategy,
would be subject to the existing moratorium related to discretionary action on any opportunity site.
The moratorium extends until November 6, 2007, or finalization and implementation of the
Downtown TOD Strategy, whichever comes first.

Staff recommends that the Board of Zoning Adjustments deny the appeal (PLN2007-00029) and
uphold the determination of the Zoning Enforcement Official that a Grocery Outlet is a supermarket
not a neighborhood grocery store. If the Board of Zoning Adjustments denies the appeal, the
appellant may appeal the decision of the Board of Zoning Adjustments to the City Council within
15 days.

APPLICANTS' SUPPORTING STATEMENT

The applicants assert that the proposed Grocery Outlet is a neighborhood grocery store at the old
Albertsons site. They state that, due to its small size of25,000 square feet, with the current industry
standard for supermarkets of 70,000 square feet, the Grocery Outlet store is more in keeping with
the neighborhood grocery store. Please see the attached applicant material for their complete
statement.
