ALAMEDA COUNTY ASSESSOR'S <br />PARCEL NUMBER 77C-1235-2-22; M. LANDES, LANDES CORP. (APPLICANT AND <br />PROPERTY OWNER). (THE PROPOSED PLANNED DEVELOPMENT IS THE SAME AS <br />APPROVED IN MARCH 6, 2006. THE PLANNED DEVELOPMENT APPROVAL EXPIRED <br />MARCH 6, 2007). <br /> <br />SUMMARY AND RECOMMENDATION <br /> <br />On March 6, 2006 the City Council approved the planned development referenced above with a <br />condition of approval that construction shall commence within one year following City Council <br />approval of the Planned Development and shall be substantially completed one year after <br />commencement of construction. For the purpose of complying with the condition, <br />commencement of construction was defined as the pouring or construction of a substantial <br />portion of the building foundation structures. Preparation of the construction documents have <br />taken longer than anticipated by the applicant. There were unusual delays in designing the <br />commerciallindustrial building. On March 6, 2007 the planned development approval expired. <br /> <br />Without any changes to the approved plans the applicant is requesting approval again to <br />redevelop the subject property. The proposal is to clear the site and to redevelop the property <br />with a new mixed-use speculative commercial/light industrial building along the front one-third of <br />the property and a self-storage facility on the remaining two-thirds of the site. <br /> <br />The project proposal remains the same. The necessary rezoning and environmental clearance <br />were granted on March 6, 2006. The construction documents are nearly complete and ready for <br />submittal to the City's Building and Safety Services Division for building permits. The Planning <br />Commission's recommendatjon js that the planned development be approved with sjmjlar <br />conditions however wjth a stricter time constraint that the application for building permit with <br />required construction documents be made to the Building and Safety Services Division withjn 30 <br />days of City Councjl's approval and that the development project be substantially completed <br />
