<br />ORDINANCE ADDING SECTION 4-1-810, TITLE 4 <br />TO THE SAN LEANDRO MUNICIPAL CODE <br /> <br />JULY 10,2007 <br /> <br />Juveniles cannot be incarcerated in the Police Department's jail. They have to be supervised in <br />an unsecured area of the Department by a Police Officer until they are either released to a parent <br />or taken to Juvenile Hall for incarceration. During this time, the Officer is unavailable to <br />respond to calls for service within the community. Additionally, if the attending Officer is a <br />School Resource Officer, he/she is unable to address problems at his/her assigned schools. <br /> <br />A minor's required attendance at school will be determined through the minor's school office. <br />Once the truancy is confirmed, the minor will be returned to school and the responding Officer <br />has the option of issuing a citation. <br /> <br />The exceptions listed as part of Section 4-1-810, Chapter 4-1, Title 4 of the Municipal Code will <br />address situations such as family emergencies, medical appointments, or participation in outside <br />work programs. <br /> <br />The City Council requested input from the City's Youth Advisory Commission (Y AC). The <br />proposed addition to the Municipal Code relating to a daytime curfew was discussed at the <br />Commission's July 9, 2007 meeting. The Y AC voted unanimously in favor of the truancy <br />ordinance.
