Lopez-Perez (applicant and property owner) <br /> <br />THIS AGREEMENT is entered into by and between the CITY OF SAN LEANDRO, a municipal <br />corporation, hereinafter referred to as "City," and Santos B. Lopez-Perez, an individual, hereinafter <br />referred to as "applicant" and "property owner". <br /> <br />Applicant applied for and received approval of a Site Plan Review and Conditional Use Permit; to <br />construct a 1,487 square-foot addition to the rear of the 1,016 square-foot existing single-family <br />home at 1338 Pacific Avenue to create a duplex. The two-family home would be single-story, <br />and includes a detached two-car garage and two surface parking spaces. Site Plan Review is <br />required as this proposal creates a new living unit. The conditional use permit is required as the <br />lot is 40 feet wide where 50 feet is the minimum lot width in the RD District and as the proposal <br />includes a parcel map to convert the resulting two-family home into a condominium for sale as two <br />individual units. 1338 Pacific Avenue; Assessor's Parcel Number 75-115-65. <br /> <br />NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Code, it is <br />mutually agreed as follows: <br /> <br />1. Applicant agrees to comply with the Conditions of Approval adopted by the City of San <br />Leandro Board of Zoning Adjustments, more specifically described in the list of Conditions of <br />Approval, attached hereto, and as described in the exhibits on file in the Community Development <br />Department, all of which are incorporated herein by this reference. <br /> <br />2. This agreement shall be binding upon and inure to the benefit of the parties hereto and <br />their respective heirs, successors, and assigns. <br /> <br />3. City is authorized to record this agreement and any amendments thereto with the <br />Alameda County Recorder, California. All amendments hereto must be in writing and signed by <br />the appropriate authorities of the City and Applicant.
