Lopez-Perez (applicant and property owner) <br /> <br />I. COMPLIANCE WITH APPROVED PLANS <br /> <br />A. The applicant shall comply with Exhibits A through E, attached to the staff report dated <br />March 15,2007, except as hereinafter modified. (Exhibits are on file at the City of San <br />Leandro Community Development Department, 835 East 14th Street, San Leandro, <br />California). <br /> <br />Exhibit A - Vicinity Map, Streetscape and Left Elevation <br />Exhibit B - Site Plan and Floor Plan of Proposed Rear Unit <br />Exhibit C - Front and Rear, Right and Left Side Elevations <br />Exhibit D - New Garage Floor Plan and Sections <br />Exhibit E - New Garage Elevations and Section <br /> <br />B. The applicant and/or property owner shall be responsible for assuring that any successor <br />in interest who assumes responsibility for this zoning approval is informed of its terms <br />and conditions. <br /> <br />C. Construction shall commence within one (1) year following Board of Zoning <br />Adjustments approval of the Conditional Use Permit and shall be substantially <br />completed one year after commencement of construction. For the purpose of <br />compliance with this condition, commencement of construction shall be defined as <br />the pouring or construction of a substantial portion of the building foundation <br />structures. Pursuant to Zoning Code Section 5-2218, this approval shall lapse on March <br />15, 2008 unless a) a building permit has been issued, coupled with diligent progress <br />evidencing a good faith intent to commence the intended use, or b) a written request for <br />a one-year extension of the use permit is approved by the Zoning Enforcement Official. <br /> <br />II. USE RESTRICTIONS <br /> <br />A. This conditional use permit and site plan review approves construction of an attached <br />1,487 square-foot one-story dwelling unit to the rear of the existing 1,1 06 square foot <br />home, thereby creating a duplex, a new 200 square-foot storage area for the existing <br />home, and a new 440 square-foot two-car garage at 1338 Pacific Avenue. In addition, <br />the conditional use permit approves conversion of the resulting two-family home <br />(duplex) into a condominium for sale as two individual units. Said parcel is also known <br />as Alameda County Assessor's Parcel Numbers 75-115-65; S. Lopez Perez (applicant <br />and property owner). <br /> <br />B. Any changes to the approved exterior design of the duplex building shall be submitted <br />in writing as a request to the Community Development Director.
