<br />DRAFT MINUTES <br />City of San Leandro City Council Meeting-July 9, 2007 <br /> <br />Page 7 <br /> <br />neighborhood grocery store. Councilmember Souza stated that she subsequently went <br />to the Grocery Outlet website and found the information related by one of the speakers. <br />She noted that Grocery Outlet listed several supermarkets as its competitors, but did not <br />list any neighborhood grocery stores. Councilmember Souza noted that much of the <br />information on its web site indicates to her that Grocery Outlet is not a neighborhood <br />grocery store. She expressed her support for denying the appeal. <br /> <br />Councilmember Starosciak commented she had expected to be presented with a <br />description of a Grocery Outlet and why it should be considered a neighborhood grocery <br />store rather than a supermarket, and was instead presented with a public opinion poll. <br />She indicated that she does not have any information to refute the decision of the <br />Zoning Enforcement Official. Councilmember Starosciak gave Porter's Market as an <br />example of a neighborhood market. Councilmember Starosciak asked if Grocery Outlet <br />would be free to apply for a Conditional Use Permit if the moratorium expired and no <br />new strategy was adopted. Ms. Livermore replied that, if that situation occurred, <br />Grocery Outlet's application for a Conditional Use Permit would be scheduled for a <br />BZA hearing. <br /> <br />Councilmember Stephens commented that based upon the information presented, he <br />considered Grocery Outlet to be a low-cost discount supermarket and would support the <br />motion denying the appeal. <br /> <br />. Minute Order No. 2007-070, Motion Denying the Appeal by Grocery Outlet, Inc. <br />and Norcal Al, LLC, Applicants, and Upholding the Determination of the Board <br />of Zoning Adjustments and the Zoning Enforcement Official that the Proposed <br />Grocery Outlet at 1550 East 14th Street, APN 77-540-9, Is Considered a <br />Supermarket. (2761) <br /> <br />The City Council denied the appeal by Grocery Outlet, Inc. and Norcal AI, <br />LLC, Applicants, and upheld the determination of the Board of Zoning <br />Adjustments and the Zoning Enforcement Official that the proposed <br />Grocery Outlet at 1550 East 14th Street, APN 77-540-9, is considered a <br />supermarket. <br /> <br />M/S/C Gregory and Stephens. Ayes: 7; Noes: 0 <br /> <br />3. PUBLIC COMMENTS <br /> <br />Public Comments are limited to 3 minutes per speaker, subject to adjustment by the Mayor. <br />When you address the City Council, you should fIll out a speaker card and submit it to the <br />City Clerk so the order of speakers may be determined and an official record of names and <br />addresses obtained. The public is invited to make comments on items of public interest NOT <br />listed on the Agenda. <br />
