POS <br /> <br />City of San Leandro <br />835 E. 14th Street <br />San Leandro, California 94577 <br />Attn: Community Development Director <br /> <br />~\ <br />}A) <br />f' <br /> <br />EXEMPT FROM RECORDING FEES PER GOVERNMENT CODE <br />SS6103, 27383 <br /> <br />(SPACE ABOVE THIS LINE RESERVED FOR RECORDER'S USE) <br /> <br />INCLUSIONARY HOUSING AGREEMENT <br /> <br />THIS INCLUSIONARY HOUSING AGREEMENT (the "Agreement") is made this 27th day <br />of J..lliy, 2007, by and between Arbor Place Partners, LLC ("Developer"), and the CITY OF SAN <br />LEANDRO ("City"). <br /> <br />RECITALS <br /> <br />WHEREAS, Developer is the owner of that certain real property, known as Alameda <br />County Assessor's Parcel No. 75-12-7, located at 1537 Hays Street in the City of San Leandro, <br />California (the "Hays Property"); and <br /> <br />WHEREAS, Developer intends to develop six (6) for-sale residential units on the Hays <br />Property ["Arbor Place" (PLN2005-00141)]; and <br /> <br />WHEREAS, pursuant to Article 30 of the San Leandro Zoning Code, in connection with the <br />Arbor Place Development, Developer is required to either (a) construct one (1) for-sale residential <br />unit to be made available to a low-and moderate-income household ("Affordable Unit"), or (b) <br />make an in-lieu payment to the City of San Leandro Affordable Housing Trust Fund ("In-Lieu Fee"); <br />and <br /> <br />WHEREAS, Developer is the developer of nine (9) for-sale residential units known as <br />Alameda County Assessor's Parcel No. 75-120-61-4, located within the City of San Leandro, <br />California ["Toscani Place" (PLN2005-00049)]; and <br /> <br />WHEREAS, Developer has requested, and City agrees to permit satisfaction of <br />Developer's In-Lieu Fee requirement for the Arbor Place development by allowing Developer to <br />restrict the sale of one (1) residential unit in the T oscani Place development, located at 1109 Davis <br />Street (or Unit 7 in Exhibit A), San Leandro, California (the "Affordable Unit"), to a moderate- <br />income household. The one (1) moderate-income unit is a four-bedroom and 3 bathroom <br />townhouse and approximately 1,515 square feet of livable space.
