<br />Planning Commission Meeting Minutes <br />Agenda No. 07-16 <br /> <br />August 23, 2007 <br />Page 17 of 19 <br /> <br />timeframe would discourage the owner from make near-term improvements on the <br />property. <br /> <br />Vice Chair Dlugosh suggested that references in the documents that affect the Red <br />Mountain property (specifically as regards the SP-I overlay) be removed from the <br />recommendations and be reserved for future discussion, because it is not something that <br />can be negotiated satisfactorily in this forum. <br /> <br />Chair Reed asked if this is done, will it come back before the Planning Commission <br />again before it goes to the City Council? <br /> <br />Vice Chair DJugosh expects it would have to come back to the Planning Commission if <br />the overlay were to be applied. <br /> <br />Assistant City Attorney Stuart pointed out that the Planning Commission is charged <br />only with making a recommendation; the City Council has the discretion whether to act <br />in accordance with that recommendation. Thus, the matter mayor may not come back to <br />the Planning Commission. <br /> <br />Chair Reed agreed, "We never have the final say; we always are recommending. . . we <br />understand our role." <br /> <br />Commissioner Collier asked about the timing of the Housing Element review. <br /> <br />Secretary Livermore said that the process for the next Housing Element will begin in <br />2008, just about five months away. <br /> <br />Motion to Forward to City Council with a Recommendation for Approval <br /> <br />Certification of the Final Environmental Impact Report (FEIR) for the <br />downtown San Leandro Transit-Oriented Development (TOD) Strategy <br />(SH #2006042102) <br />with the Exception of Anything That May Apply to the SP-1 Overlay <br /> <br />Dlugosh / Finberg; 7 Ayes, 0 Noes - Approved <br /> <br />Motion to Forward to City Council with a Recommendation for Approval <br /> <br />Adoption of the Downtown Transit-Oriented Development (TOD) Strategy <br />with the Exception of Anything That May Apply to the SP-1 Overlay <br /> <br />Dlugosh / Finberg; 6 Ayes, 1 No (Collier) - Approved <br />
