Resolution Approving Contractual Services Agreement Between the City of San <br />Leandro and EIP Associates, a Division of PBS&J Related to Preparing the <br />Environmental Impact Report (EIR) for the ICI Development Company Retail and <br />Mixed-Use Residential Development in San Leandro in an Amount Not to Exceed <br />$487,614 (provides for preparation of an EIR for the subject development on a portion <br />of the former Albertson's Distribution Center site). Funding: Cost to be reimbursed <br />100% by ICI Development Company. (Moved to Item 9, Items Removed from <br />Consent Calendar.) (2323/3098) <br /> <br />9. ITEMS REMOVED FROM CONSENT CALENDAR <br /> <br />Public comments are limited to 3 minutes per speaker per item, subject to adjustment by the <br />Mayor. <br /> <br />8.D. Ordinance No. 007-018, an Ordinance Adding Title 1, Chapter 6, Article 6 of the San <br />Leandro Municipal Code Relating to Living Wage (requires City contractors, service <br />providers, financial aid recipients and lessees or franchisees to pay a living wage to all <br />employees which is generally, but not always, greater than might be paid in a private <br />market setting). (3120) <br /> <br />Councilmember Souza stated that while she supports the living wage ordinance, she <br />was disappointed that the final ordinance language had not been reviewed by the City <br />Council Finance Committee. She expressed concern regarding the worker retention <br />requirement in Section 11 (b), noting that some companies do not keep seniority lists. <br />Councilmember Souza commented that the section excludes supervisory, managerial <br />and confidential positions, which are the higher paid employees most at risk for job loss <br />when a company is replaced by another. Councilmember Souza commented that the <br />language in this section goes beyond what she would like to see in the ordinance; <br />however, she stated that the ordinance is an important document, and she is proud that <br />San Leandro has it. <br /> <br />Public Comments on Item 8.D.: <br /> <br />Sharon Cornu, Central Labor Council of Alameda County, addressed the City <br />Council, commenting on the worker retention provision of the ordinance. Ms. Cornu <br />noted that low wage workers such as the janitorial staff who clean the Council Chamber <br />could be at risk if a company changed ownership, and they would be the types of <br />workers that would be protected under the ordinance. Ms. Cornu commented that only <br />those companies that seek City contracts and City funding would be bound by the <br />ordinance. Ms. Cornu strongly urged the Council's support for the ordinance. <br />
