<br />Changes have been required of and incorporated into the project. These changes would <br />substantially lessen the significant environmental effects thereof as identified in the Final EIR. <br /> <br />This finding is based on the fact that the City of San Leandro shall require developers building <br />under the TOO Strategy to implement the following mitigation measures: <br /> <br />Mitil!ation for Construction Air Qualitv Impacts <br /> <br />Prior to any new development occurring within the TOD Strategy Area, the City of San <br />Leandro shall require that, in accordance with the BAAQMD CEQA Guidelines, the <br />construction contractor shall implement the following dust control measures as applicable <br />during all project construction activities (General Plan EIR Mitigation Measure Kl): <br /> <br />Water all active construction areas at least twice daily. <br /> <br />Water or cover stockpiles of debris, soil, sand or other materials that can be blown <br />by the wind. <br /> <br />Cover all trucks hauling soil, sand, and other loose materials or require all trucks <br />to maintain at least two feet of freeboard. <br /> <br />Pave, apply water three times daily, or apply (non-toxic) soil stabilizers on all <br />unpaved areas at the construction site. <br /> <br />Sweep daily (preferably with water sweepers) all paved access road, parking areas <br />and staging areas at construction site. <br /> <br />Sweep streets daily (preferably with water sweepers) if visible soil material is <br />carried onto adjacent public streets. <br /> <br />Biolol!ical Resource Impacts <br /> <br />Due to the heavily urbanized nature of the TOD Strategy area, no endangered, rare or threatened <br />species are known to exist within its boundaries. Development within the TOD Strategy Area <br />has the potential to result in cumulative impacts on sensitive biological resources, including a <br />California State species of concern (Alameda Song Sparrow). San Leandro Creek, which is <br />located in the Strategy area, is a federally-protected wetland and is identified by the US Fish and <br />Wildlife Service in the National Wetlands Inventory. A substantial portion of the development <br />associated with the TOD Strategy would be immediately adjacent to the creek and could impact <br />the riparian corridor. <br /> <br />The City of San Leandro finds that, as to the significant effect identified above: <br /> <br />Changes have been required of and incorporated into the project.
