<br />Downtown TOD Strategy; and <br /> <br />WHEREAS, a legal ad was placed in the Daily Review and notices were sent to 983 property <br />owners and to another 394 interested parties to inform them of the proposed Zoning Code and <br />Zoning Map changes; and <br /> <br />WHEREAS, a Response to Comments document, which together with the DEIR constitutes <br />the Final Environmental Impact Report ("Final EIR"), has been prepared and circulated; and <br /> <br />WHEREAS, no new information was produced by City staff, the Final EIR authors or <br />public comment during the preparation of the Final EIR on the Downtown TOD Strategy which <br />would require recirculation pursuant to the California Environmental Quality Act ("CEQA"); <br />and <br /> <br />WHEREAS, the responses to comments contained in the Final EIR on the Downtown <br />TOD Strategy result from a process of multidisciplinary and agency discussions and represent a <br />responsive, good faith evaluation of each comment; and <br /> <br />WHEREAS, in August 2007, the Final EIR on the Downtown TOD Strategy was released <br />and was made available for public review; and <br /> <br />WHEREAS, on August 23, 2007, the City of San Leandro Planning Commission considered <br />the Final EIR on the Downtown OD Strategy and received public comments thereon, and <br />recommended that this Council certify the Final EIR as complete. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San <br />Leandro as follows: <br /> <br />1. The foregoing recitals are true and correct and incorporated herein as findings. <br /> <br />2. Compliance with CEQA. The City Council certifies that: the Final EIR for the <br />Downtown TOD Strategy attached hereto as Exhibit A (On file: Office of the City Clerk), dated <br />August 17, 2007, has been prepared in compliance with the requirements of CEQA; it has been <br />presented to the City Council; the City Council has reviewed and considered the information <br />contained in the Final EIR for the Downtown TOD Strategy, including the record of oral and <br />written comments received during the comment period for the Draft EIR; that public participation in <br />the preparation and review of the Final ErR for the Downtown TOD Strategy has been adequate and <br />in accordance with CEQA; that the Final EIR reflects the independent judgment of the City <br />Council; and all of the information contained therein has substantially influenced all aspects of the <br />decision by the City Council. <br /> <br />3. CEQA Findin2;s of Fact Re2;ardin2; Si2;nificant Effects. Section 21081(a) of <br />the Public Resources Code requires the City Council to make certain findings regarding the <br />significant effects of the proposed Downtown TOD Strategy (the "Findings"). These findings are <br />made for each significant impact identified in the Final EIR, including effects that would be <br />significant, but that will be mitigated by mitigation measures identified in the Final EIR.
