<br />City Council adopts the Findings, attached hereto as Exhibit B for each significant impact <br />identified in the EIR and for each project alternative identified in the EIR. The project <br />alternatives findings include findings for the rejection of each alternative analyzed in the EIR. <br />The City Council, exercising its own independent judgment, determines that all such Findings <br />are supported by substantial evidence in the record. <br /> <br />4. Statement of Overriding Considerations. In accordance with Section 21081 of <br />the Public Resources Code and Section 15093 of the State CEQA Guidelines, in order to approve <br />the project, the City Council must make a statement, supported by findings, as to the specific <br />economic, legal, social, technological, or other benefits of the project, including considerations <br />for the provision of increased pedestrian opportunities, promotion of development of properties <br />adjacent to BART stations and along heavily-used public-transit corridors, which outweigh the <br />project's unavoidable environmental impacts. The City Council has balanced the benefits of the <br />proposed project against its unavoidable environmental risks in determining whether to approve <br />the project and has determined that the adverse environmental effects are acceptable. The City <br />Council adopts the Statement of Overriding Considerations, also contained in Exhibit B. <br /> <br />5. Unavoidable Si2:nificant Impacts. The City Council hereby finds and <br />determines that the selected project would result in the occurrence of significant effects which <br />cannot be avoided or substantially lessened in its contribution to significant cumulative impacts <br />on regional air quality and schools, as well as significant, unavoidable impacts on noise, schools, <br />and transportation and circulation impacts. Having balanced these unavoidable significant <br />impacts against the benefits of the selected project, this Council finds that the benefits of the <br />selected project outweigh its unavoidable adverse environmental effects, and therefore finds <br />those adverse environmental effects to be acceptable, as set forth in more detail in Exhibit B. <br /> <br />6. Miti2:ation Monitorin2:. Pursuant to Section 21081.6 of the Public Resources <br />Code, the mitigation monitoring plan set forth in the attached Exhibit C is hereby adopted and <br />incorporated herein by this reference to ensure that all mitigation measures adopted for the <br />project are fully implemented. <br /> <br />7. Location and Custodian of Documents. The record of project approval shall be <br />kept in the office of the City Clerk for the City of San Leandro, located at 835 E. 14th Street, San <br />Leandro, CA 94577. <br /> <br />8. Certification. Based on the above facts and findings, the City Council of the City <br />of San Leandro hereby certifies as lead agency for the Downtown TOD Strategy that the Final <br />EIR for this project is accurate and adequate. The Council further certifies that the Final EIR <br />was completed in compliance with CEQA and the State CEQA Guidelines.
