<br />WHEREAS, a legal notice was published in the Daily Review and public notices were <br />sent to 983 property owners and to another 394 interested parties at least 10 days before each <br />public hearing, to inform them of the time and place of the Planning Commission and City Council <br />public hearings and of the proposed action on the Final EIR, the TOD Strategy and the Zoning <br />Code and Zoning Map Amendments; and <br /> <br />WHEREAS the proposed Zoning Map amendments are necessary to provide a <br />framework for implementing the proposed Downtown TOD Strategy. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as <br />follows: <br /> <br />Section 1. The foregoing recitals are true and correct. <br /> <br />Section 2. Certain properties of Downtown San Leandro are hereby amended, as indicated <br />with addresses and Assessor's Parcel Numbers attached, and as shown on Exhibit A. <br /> <br />Section 3. Certain properties of Downtown San Leandro are rezoned to S-Overlay, <br />including DA-1 (S), DA-4 (S) PS (S) and OS (S) and are hereby amended as shown on Exhibit B. <br /> <br />Section 4. The City of San Leandro Official Zoning Map is hereby amended as shown on <br />Exhibits A and B, filed in the office of the City Clerk on September 4,2007. <br /> <br />Section 5. Effective Date and Publication. <br /> <br />This ordinance shall take effect thirty (30) days after adoption and the title thereof shall <br />be published once prior to adoption. The City Clerk is directed to post a complete copy thereof <br />on the City Council Chamber bulletin board for five (5) days prior to adoption. <br /> <br />Section 6. Severability. <br /> <br />If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the <br />ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any court of <br />competent jurisdiction, such decision shall not affect the validity or effectiveness of the <br />remaining portions of this Ordinance or any part hereof. The City Council hereby declares that it <br />would have passed each section of the Ordinance irrespective of the fact that one or more of them <br />would be declared unconstitutional or invalid.
