<br />DRAFT MINUTES Page 6 <br />City of San Leandro City Council, San Leandro Economic Development Agency, and San Leandro Redevelopment <br />Agency Joint Meeting-September 4, 2007 <br /> <br />Lou Filipovich, San Leandro resident, addressed the City Council, expressing <br />concern that taxpayer money was being used for this item and that there was no <br />accountability for the expenditure of the money. <br /> <br />Barry Luboviski, Building Construction Trades Council, addressed the City <br />Council, commenting on the letter sent to the Council by Sharon Cornu of the Central <br />Labor Council, which expressed support for the Downtown TOD Strategy in moving <br />toward a more transit- and pedestrian-friendly environment. Mr. Luboviski <br />commented that the Building Trades Council and Central Labor Council support the <br />Strategy, but would like to see more attention paid to the proposals by Congregations <br />Organized for Renewal (COR) in order to maintain economic diversity in housing for <br />working families. <br /> <br />Dennis Davis, Roman Catholic Clergy, addressed the City Council, commenting <br />that the TOD Strategy provides a great opportunity for the community to ensure a <br />better quality of life for its residents, but needs to include a stronger low-income <br />housing component. Mr. Davis requested that the Council consider including an <br />inclusionary zoning overlay with a 20% requirement in the Downtown TOD area. <br /> <br />Dan Martinez, COR, addressed the City Council, commenting that COR has <br />attended all meetings and hearings for the TOD Strategy and hosted its own <br />community forum at St. Leander's Parish. Mr. Martinez stated that COR recommends <br />that language be added to the plan identifYing affordable housing as a development <br />objective for four opportunity sites, particularly for the east BART parking lot and <br />North Alvarado sites; that the Redevelopment Agency increase the percentage of <br />redevelopment funds set aside for affordable housing to 25%; that the fee be increased <br />for conversion of rental units to for~sale units; that an inclusionary zoning overlay be <br />created for the Downtown TOD area; and that the Rent Review Board be revived and <br />strengthened. <br /> <br />Marilyn Winkler, San Leandro resident, addressed the City Council, providing an <br />air quality map to the City Council and expressing concern that the Downtown area <br />proposed for housing development is in the top 50% of areas most heavily exposed to <br />diesel emissions containing toxic contaminants. Ms. Winkler commented on the <br />shortage of BART parking and the possibility that the implementation of the TOD <br />Strategy would further reduce the number of BART parking spaces. <br /> <br />Eric A. Nelson, Red Mountain Retail Group, addressed the City Council, providing <br />the Council with a copy of a letter from his attorney and a copy of his comments. Mr. <br />Nelson commented that Red Mountain views the plan as a form of spot zoning that <br />violates its property, equal protection and due process rights, and that the SP-l <br />requirement for all new retail ground floor uses to provide residential on the second <br />floor results in a taking of its property rights in violation of the U.S. and State <br />Constitutions. <br />
