Tract 7382 Summary Vacation 2 October 15, 2007 <br />easement abandonment. The procedure for summary vacation is outlined in Title V, Chapter 4, <br />of the San Leandro Municipal Code and in Part 3, Division 9 of the Streets and Highway Code. <br />Per Chapter 4 of Part 3, Division 9, Section 8333(b) of the Streets and Highway Code, the <br />legislative body of the local agency may summarily vacate a public service easement if "the date <br />of dedication or acquisition is less than five years, and more than one year, immediately <br />preceding the proposed vacation, and the easement was not used continuously since that date." <br />This condition is satisfied since the subject EVAE was dedicated in June 2003 with the <br />recordation of Tract Map 7382. Furthermore, the subject easement was never utilized since Lots <br />4 and 5 have yet to be developed. <br />A new EVAE will be dedicated to the City in place of the existing easement to be abandoned. <br />The Alameda County Fire Department has approved the new EVAE configuration, which will <br />follow the drive aisle for the new National Construction Rentals facility.
