Tract 7382 Summary Vacation 2 October 15, 2007 easement abandonment. The procedure for summary vacation is outlined in Title V, Chapter 4, of the San Leandro Municipal Code and in Part 3, Division 9 of the Streets and Highway Code. Per Chapter 4 of Part 3, Division 9, Section 8333(b) of the Streets and Highway Code, the legislative body of the local agency may summarily vacate a public service easement if "the date of dedication or acquisition is less than five years, and more than one year, immediately preceding the proposed vacation, and the easement was not used continuously since that date." This condition is satisfied since the subject EVAE was dedicated in June 2003 with the recordation of Tract Map 7382. Furthermore, the subject easement was never utilized since Lots 4 and 5 have yet to be developed. A new EVAE will be dedicated to the City in place of the existing easement to be abandoned. The Alameda County Fire Department has approved the new EVAE configuration, which will follow the drive aisle for the new National Construction Rentals facility. Exhibits showing the new easement and the one to be abandoned are attached to the resolutions.
