<br />CITY OF SAN LEANDRO <br />MEMORANDUM <br />DATE: September 12, 2007 <br />TO: Finance Committee <br />FROM: Steve Hollister, Assistant City Manager <br />Jesse Baloca, Finance Director <br />,~ . <br />BY: Don Brockman, Purchasing Agent "~~ <br />SUBJECT: Living Wage Ordinance - Administrative Guidelines, Employee Notice, <br />Frequently Asked Questions, and Employer Self-Certification Form <br />Staff recommends that Finance Committee approve the City of San Leandro Administrative <br />Guidelines, Employee Notice, Frequently Asked Questions (FAQ's), and Employer Self- <br />Certification Form. The attached aids will assist the City with implementing, administering, and <br />monitoring compliance with the City's new Living Wage Ordinance (LWO). <br />Background and Discussion <br />The City of San Leandro City Council adopted Title 1, Article 6, Chapter 6 of the City Municipal <br />Code, LWO, with an effective date of September 1, 2007. Staff was charged with developing <br />guidelines and documents, and an administrative process for implementing the LWO. <br />The Documents <br />The Guidelines enhance and address the way the LW~ is to be implemented, such as whether <br />tips and gratuities are to be included in the calculation of employee wages. The FAQ's attempt <br />to answer some of the anticipated questions related to the LWO. The self-certification document <br />provides an easy to use form for employers to complete to determine if they are affected by the <br />LWO. The form also provides documentation for the city that the employer is covered, and <br />allows for periodic recertification. The Notice to Employees is intended for employee <br />notification of living wage rights in the workplace and fox employer distribution and display in <br />the workplace. The notice will also be available in Spanish. <br />Contract Language <br />A new section will be added to the City's contracts and in its bids for services, for which the <br />LWO will be applicable, and will be similar to the prevailing wage section that currently exists. <br />Contracts covered by the LWO will have a section inserted that will read as follows: <br />
