IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />.RESOLUTION NO. 2007-136 (1007/2925) <br />RESOLUTION SUMMARILY VACATING THE EMERGENCY VEHICLE ACCESS <br />EASEMENT ON LOT 4 OF TRACT 7382, 1300 BUSINESS CENTER DRIVE, <br />SAN LEANDRO, A PORTION OF ASSESSOR'S PARCEL NO. 079A-0591-011 <br />RECITALS <br />WHEREAS, the easement to be summarily vacated by this resolution is located along the <br />easterly and southerly boundaries of Lot 4 of Tract 7382 and is more precisely described in <br />Exhibits A and B, attached hereto, and made a part hereof; and <br />WHEREAS, the subject portion of land is not required for street, utility, or emergency <br />vehicle access purposes; and <br />WHEREAS, the proposed vacation has been found to be categorically exempt from the <br />California Environmental Quality Act; and <br />WHEREAS, said summary vacation is made under Chapter 4 (Summary Vacation), Part <br />3, Division 9, Section 8333(b), of the California Streets and Highway Code. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />1. That the City Council hereby orders the summary vacation of the herein above <br />described Emergency Vehicle Access Easement (EVAE). <br />2. That from and after the date of recordation of this resolution, said portion of land no <br />longer constitutes a public service easement. <br />3. That the City Council hereby accepts the new EVAE. <br />4. That the City Clerk shall cause a certified copy of this resolution to be recorded in the <br />Office of the Recorder of Alameda County, California, immediately upon its <br />adoption. <br />
