in the Commercial Downtown (CD) zoning district until such time as this Ordinance and any <br />extension thereof has expired, or new zoning or other regulations of the City which expressly <br />supersede this interim moratorium have become operative, whichever is earlier. This <br />moratorium does apply to temporary Retail Sales uses in excess of 10,000 square feet as long as <br />the temporary use does not extend longer than 90 days after occupancy. <br />Section 3. Environmental Review. <br />The City Council finds that the adoption of this Ordinance is exempt from environmental <br />review under the California Environmental Quality Act pursuant to Public Resources Code <br />section 21065 based on the finding that this Ordinance is not a "project" within the meaning of <br />Section 15378 of the State CEQA Guidelines, because it has no potential for resulting in physical <br />change in the environment, directly or ultimately. The adoption of this interim ordinance is <br />further exempt from environmental review pursuant to Section 15305 of the State CEQA <br />Guidelines, because it is a minor change in land use regulations that will not result in any <br />changes to underlying zoning standards. <br />Section 4. Effective Date. <br />This ordinance shall take effect immediately as an urgency measure for the immediate <br />preservation of public health, safety, and welfare. This Ordinance shall be of no further force <br />and effect later than 10 months and 15 days from the date of its adoption, unless otherwise <br />extended by the City Council. <br />Section 5.
