NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as <br />follows: <br />Section I. Findings. <br />The City Council of the City of San Leandro does hereby find as follows: <br />(A) The permitted and conditionally permitted uses listed in the Zoning Code for the <br />CD Zoning District have not been updated to reflect more-recent planning documents, including <br />the City's General Plan, the Downtown Plan and Urban Design Guidelines, and the stated goals <br />and policies for the Plaza Redevelopment Area. The current ability of a large-scale retail <br />development and similar uses in downtown San Leandro threatens to impede or prevent the <br />accomplishment of fundamental goals and policies related to establishing and maintaining a vital <br />core of economic and community activity in downtown San Leandro, which goals and policies <br />are integral to achieving the purposes of the General Plan and applicable redevelopment plans. <br />(B) There is a limited supply of convenient parking in the downtown shopping <br />district, and the impact of large retail establishments, and similar uses could impede the City's <br />efforts to ensure necessary and adequate parking to support the City's goals relating to <br />revitalization of downtown San Leandro. In addition, many of the older properties are not up to <br />current development standards with regard to landscaping and architecture. Without some City <br />oversight/discretion for certain properties as they change over, such properties will continue to <br />decline in their appearance and not contribute positively to the image for the downtown that has <br />been set forth in the various planning documents. <br />Section 2. Section 2-608 of Article 6 of the San Leandro Zoning Code is amended as <br />set forth in Exhibit A, which is attached and incorporated by reference into this Ordinance. <br />Section 3. Effective Date and Publication. <br />This ordinance shall take effect thirty (30) days after adoption and the title thereof shall <br />be published once prior to adoption. <br />Section 4. Repeal of Interim Urgency Ordinance. <br />Upon the effective date of this Ordinance, the Interim Urgency Ordinance Prohibiting <br />Consideration and Approval of Use Permits, Variances, Building Permits, Start of New <br />Construction or Other Entitlements for all New Retail Sales uses in excess of 10,000 s.f. in size <br />in the Commercial Downtown Zoning District (Ordinance No. 2005-016) is repealed and of no <br />further effect. <br />ORDINANCE NO. 2005-021 2 <br />
