Leandro, the City Clerk shall submit a certificate of these facts to the City Council, and inform <br />them that they may, at a regular or special meeting held before the November 2, 2004 Municipal <br />Election, adopt one of the following courses of action: <br />(1) Appoint to the office the person who has been nominated. <br />(2) Appoint to the office any eligible elector if no one has been nominated. <br />(3) Hold the election if either no one or only one person has been nominated. <br />The City Clerk shall publish a notice of the facts described in this section and the <br />available courses of action. Publication shall be made pursuant to Section 6061 of the <br />Government Code in any newspaper of general circulation as designated by the Clerk. <br />The procedures for these appointments or elections shall be conducted in accordance with <br />Elections Code Section 10229. <br />Section 7: PROVISION IF NO ONE OR ONLY ONE PERSON NOMINATED: <br />(a) If, by 5:00 p.m. on the 83rd day before the November 2, 2004 General Election, no <br />one or only one person has been nominated for any elective office to be filled at that election, and <br />the election is subject to Section 36512 of the Government Code, the City Clerk shall submit a <br />certificate of these facts to the City Council and inform them that they may, at a regular or special <br />meeting held before the November 2, 2004 General Municipal Election, adopt one of the <br />following courses of action. <br />(1) Appoint to the office the person who has been nominated. <br />(2) Appoint to the office any eligible elector if no one has been nominated. <br />(3) Hold the election if either no one or only one person has been nominated. <br />The City Clerk shall publish a notice of the facts described in this section and the courses <br />of action available under this subdivision. Publication shall be made pursuant to Section 6061 of <br />the Government Code in any newspaper of general circulation as designated by the Clerk. <br />The procedures for these appointments or elections shall be conducted in accordance with <br />Elections Code Section 10229. <br />Section 8: Run-off elections shall be conducted as set forth by Ordinance establishing <br />procedures for the conduct of such elections. <br />Section 9: The title of this ordinance shall be published once and the City Clerk shall <br />post a complete copy thereof on the City Council Chamber bulletin board for five (5) days <br />following its adoption. <br />ORDINANCE NO. 2004-011 2 <br />
