SEC. 2-16-210 Imposition of Emergency Communication System Access Fee. <br />A. There is hereby imposed an Emergency Communication System Access <br />Fee on every person who maintains access to the 911 communication system by <br />subscribing to local telephone service within the City of San Leandro. For purposes of <br />this Chapter, with respect to wireless telephone services, a person shall be construed to <br />subscribe to local telephone service within the City of San Leandro if he or she has a <br />"place of primary use" as such term is defined in the Mobile Telecommunications <br />Sourcing Act, 4 U.S.C. Section 124(8), within the geographic boundaries of the City. <br />B. The amount of the fee imposed by this Section shall be established by City <br />Council resolution and shall be paid on a per-line basis, by the person paying for such <br />local telephone service. The fee amount shall not result in the City collecting a total fee <br />amount in excess of the eligible operating cost and eligible project cost of the 911 <br />communication system. The fee shall be adjusted annually by the City Council through <br />its annual fee review process. The adjustment shall be based on the Annual Report <br />described in Section 2-16-220. No subscriber will be required to pay fees in excess of <br />$10,000 per account per service location in any fiscal year. This cap will be adjusted <br />annually by the percentage increase in the Consumer Price Index: All Urban Consumers <br />(San Francisco-Oakland-San Jose), as reported by the United States Bureau of Labor <br />Statistics. <br />C. Only one payment of the fee herein imposed shall be required for any <br />access line, trunk line, or super trunk line, notwithstanding that access lines of more than <br />one service supplier are used in furnishing local telephone service to a telephone <br />subscriber. <br />D. Revenues generated by the Emergency Communication System Access <br />Fee shall be deposited in the Emergency Communication System Access Fund and shall <br />be used exclusively to pay for eligible operating costs and eligible project costs. <br />E. In the first year this fee is imposed, the fee will be determined based on <br />the estimated number of access lines, and project and operating costs as budgeted for that <br />year, as determined by the Finance Director. <br />SEC.2-16-215 Exemptions. <br />Nothing in this Chapter shall be construed as imposing a fee upon the access lines <br />of: <br />A. A lifeline customer of a service supplier; or <br />B. A telephone corporation; or <br />C. Coin-operated telephones; or <br />ORDINANCE NO. 2004-0] 5 6 <br />
