seeks to locate in these districts. <br />(3) Therefore, a crematorium may locate in these districts by only <br />obtaining a business license and a building permit from the City. <br />(4) Although a crematorium may be required to obtain a permit from <br />the Bay Area Air Quality Management District, the District's review of the application is limited <br />to narrow air quality concerns. <br />(5) Crematoria may release the following chemicals as part of their <br />operations: <br />• Acetaldehyde <br />• Arsenic <br />• Benzene <br />• Beryllium <br />• Cadmium <br />• Chromium, hexavalent <br />• Copper <br />• Formaldehyde <br />• Hydrogen Chloride <br />• Hydrogen Fluoride <br />• Lead <br />• Mercury <br />• Nickel <br />• Selenium <br />• Zinc <br />• Chlorinated dibenzo -dioxins and -furans or concern <br />• Polycyclic aromatic hydrocarbons <br />B. For the reasons set forth above and in the recitals of this Ordinance, the <br />City Council further finds that the approval of use permits, variances, building permits, new <br />construction, or other applicable entitlements for new crematoria in San Leandro would result in <br />the threat set forth above to the public peace, health, safety and welfare of its citizens. <br />C. For the reasons set forth above and in the recitals of this Ordinance, the <br />City Council further finds that a temporary moratorium on the processing and approval of use <br />permits, variances, building permits, new construction, or other applicable entitlements for the <br />uses identified herein is necessary to protect the public health, safety, and welfare. <br />Section 2. Scope. <br />Notwithstanding any other provision of the San Leandro Zoning Code, crematoria are not <br />a permitted use in any zoning district within the City. The Community Development <br />Department shall not complete, and the City shall not consider or approve any applications for <br />entitlements, including but not limited to, conditional use permits, variances, or building permits <br />for new crematoria until such time as this Ordinance and any extension thereof has expired, or <br />ORDINANCE NO. 2004-018 2 <br />708823-1 <br />
