CONDITIONS OF APPROVAL <br />PLN2005-00054 1509 Marybelle Avenue <br />Rosabella Reyes (Applicant and Property Owner) <br />L COMPLIANCE WITH APPROVED PLANS <br />A. The applicant shall comply with Exhibits A through F, attached to the application <br />dated May 13, 2005, except as hereinafter modified. (Exhibits are on file at the City <br />of San Leandro Community Development Department, 835 East 14th Street, San <br />Leandro, California). <br />Exhibit A -Plot Plan, Site Plan, Vicinity Map (A1) <br />Exhibit B -Elevations and Section (Al.l) <br />Exhibit C -Floor Plans (A2) <br />Exhibit D -Elevations and Section (A3) <br />B. The applicant and/or property owner shall be responsible for assuring that any <br />successor in interest who assumes responsibility for this zoning approval is <br />informed of its terms and conditions. <br />IL USE RESTRICTIONS <br />A. This Minor Site Plan approves the construction of a new 1,128 square-foot two- <br />story addition, including a 450 square-foot secondary unit, attached to the existing <br />1,455 square foot two-story residence. The proposed secondary unit shall not <br />exceed 30% of the existing heated floor area of the main dwelling, or 450 square <br />feet, whichever is less. Thus, the secondary dwelling shall not exceed a maximum <br />of 450 square feet in floor area. The secondary unit would include a bedroom, <br />living room, kitchen and a bathroom. The attached secondary unit would be <br />situated on the property at 1509 Marybelle Avenue, also known as Alameda <br />County Assessor's Parcel Number 77A-641-19. <br />B. Approval of a secondary dwelling unit shall not be deemed to be a division of land <br />for purposes of Government Code Section 66410 et seq. or Title VII of the <br />Municipal Code, nor shall the ministerial approval in accord with the Article entitle <br />the applicant to: <br />1. Such a division of land; or <br />2. To have each of the two (2) dwelling units on the parcel separately assessed <br />for property tax purposes. <br />C.
