CONDITIONS OF APPROVAL <br />PLN2006-00063 -109 East 14r~ Street <br />R. & B. Miller (Applicant/Property Owner) <br />h COMPLIANCE WITH APPROVED PLANS <br />A. The applicant and/or property owner shall comply with Exhibit A through C dated <br />October 12, 2006, except as hereinafter modified. (Exhibits are on file at the City of <br />San Leandro Development Services Department, 835 East 14th Street, San Leandro, <br />California). <br />Exhibit A -Site Plan <br />Exhibit B - Floor Plan <br />Exhibit C -List of Permitted Uses <br />B. The applicant and/or property owner shall be responsible for assuring that any <br />successor in interest who assumes responsibility for the zoning approval is informed <br />of its terms and conditions. <br />II. USE RESTRICTIONS <br />A. This Exception to the elimination of a legal non-conforming use allows an <br />approximately 1,160 square foot commercial portion of a mixed-use building <br />located within an RD Residential Duplex District to be re-established, at 109 East <br />14th Street; Alameda County Assessor's Parcel Number 75-197-17. <br />B. Permitted commercial uses shall be limited to the categories listed on Exhibit C. <br />C. Should the re-established legal non-conforming use be substantially discontinued or <br />changed to a conforming use for a continuous period of six months or more, this <br />exception will become null and void and use of the site thereafter shall be in <br />conformity with the regulations for the RD Residential Duplex District. <br />D. This Exception does not supersede any restrictions pertaining to legal non- <br />conforming uses as governed by Article 20 of the San Leandro Zoning Code. <br />III. SIGNS <br />A. Building permits shall be obtained for any new signs. The applicant shall submit <br />precise details for the review of the Community Development Director.
