CONDITIONS OF APPROVAL <br />PLN2006-00095 - 575 Marina Boulevard <br />Anthony A. Batarse Jr., (Applicant and Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The project shall comply with Exhibits A through F, dated January 11, <br />2007, except as hereinafter modified. (Exhibits are on file at the City of <br />San Leandro, Community Development Department, 835 East 14th Street, <br />San Leandro, California, 94577). <br />Exhibit A -Cover Sheet <br />Exhibit B - Site Plan <br />Exhibit C - First Floor Plan <br />Exhibit D -Second Floor Plan <br />Exhibit E - Elevations <br />Exhibit F - Colors and Materials Board <br />B. The applicant and property owner shall be responsible for assuring that <br />any successor in interest who assumes responsibility for this zoning <br />approval is informed of its terms and conditions. <br />C. A building permit for the project shall be obtained within one year of the <br />Zoning Enforcement Official's Site Plan Review approval of this <br />application. Construction shall commence within one (1) year of the date <br />of the issuance of the building permit for said project and shall be <br />substantially completed one (1) year thereafter. For the purpose of <br />compliance with this condition, commencement of construction shall be <br />defined as the construction of the building foundation. <br />D. All conditions of approval listed under Site Plan Review PLN2003-00036 <br />approved July 14, 2003, shall remain in full effect except as hereinafter <br />modified by this agreement and associated conditions of approval. <br />II. PERMITTED USE <br />A. This Site Plan Review is an approval to construct a new automobile <br />dealership/service building, with associated employee, customer, and <br />inventory parking. Primary use approval shall be for sales of new cars, <br />with accessory use of pre-owned cars allowed. Service of new and used <br />vehicles shall also be allowed on-site. <br />B. No application for amendment of the application or Conditions of <br />Approval be submitted or accepted for processing by the city unless (i) <br />there is full compliance with all terms of the application and Conditions of <br />Approval; or (ii) the Zoning Enforcement Official and/or Community <br />Development Director can waive compliance with the terms of the <br />application if they are minor in content. <br />Agreement to Conditions January l 1, 2007 <br />PLN2006-00095 Page 3 of 5 <br />
