G. All new utility services shall be placed underground from the appropriate utility pole <br />or service point. <br />IV GENERAL CONDITIONS <br />A. The site shall be well maintained and shall be kept free of litter, debris and weeds. <br />B. Any graffiti shall be removed from the tower, cabinet, or fencing. <br />C. The fencing and paving on the property shall be structurally sound and well <br />maintained at all times. <br />D. No ribbon or barbed wire shall be installed on the fencing. <br />E. Pursuant to Zoning Code Section 4-1686-G5, relating to Federal and State <br />Requirements, all towers must meet or exceed current standards and regulations of <br />the FAA, the FCC, the California Public Utilities Commission and any other agency <br />of the federal or state government with the authority to regulate towers and <br />antennas. If such standards and regulations are changed, then the owners of the <br />towers and antennas governed by this Section shall bring such towers and antennas <br />into compliance with such revised standards and regulations within six (6) months <br />of the effective date of such standards and regulations, unless a more stringent <br />compliance schedule is mandated by the controlling federal or state agency. Failure <br />to bring towers and antennas into compliance with such revised standards and <br />regulations shall constitute grounds for the removal of the tower or antenna at the <br />owner's expense. <br />F. Pursuant to Zoning Code Section 4-1686 G, relating to the removal of abandoned <br />antennas and towers, any antenna or tower that is not operated for a continuous <br />period of twelve (12) months shall be considered abandoned, and the owner of such <br />antenna or tower shall remove same, and restore the site to its pre-installation <br />condition, within ninety (90) days of receipt of notice from the Community <br />Development Director. The notice shall specify that the owner has the opportunity <br />to request a public hearing on the removal of the antenna or tower. If such antenna <br />or tower is not removed within said ninety (90) days, the Community Development <br />Director may remove such antenna or tower at the owner's expense. If there are two <br />(2) or more users of a single tower, then this provision shall be effective only for the <br />abandoned antenna(s). <br />G. The approvals granted by the City as a result of this application, as well as the <br />Conditions of Approval, shall be recorded in the office of the County Recorder of <br />Alameda County. <br />H. No application for amendment of the application or Conditions of Approval maybe <br />accepted or submitted for processing by the City unless (i) there is full compliance <br />Conditions of Approval February 16, 2006 <br />PLN2005-00050 Page 3 of 4 <br />
