CONDITIONS OF APPROVAL <br />PLN2005-00057 <br />1970 Republic Avenue <br />Daniel Kim, Brooks Motor Cars of San Leandro (Applicant) <br />Bruno Zuccone (Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The property owner shall comply with Exhibits A through C, attached to the staff <br />report dated July 21, 2005, except as hereinafter modified. (Copies of Exhibits A <br />thru E are on file in the Community Development Department, 835 East 14th <br />Street, San Leandro, California). <br />Exhibit A -Site Plan <br />Exhibit B -Floor Plan <br />Exhibit C -Project Description/Supporting Statement <br />B. The applicant and/or property owner shall be responsible for assuring that any <br />successor in interest who assumes responsibility for this zoning approval is <br />informed of its terms and conditions. <br />II. PERMITTED USE <br />A. This conditional use permit is to allow an office for vehicle retail sales of used <br />cars and two indoor designated display spaces. Vehicles will be sold by <br />appointment only at 1970 Republic Avenue, Assessor's Parcel Number 77A-646- <br />11-12. Any change or addition to the operation of the used car sales business, <br />including increase in office space or additional vehicle display space, shall be <br />subject to the review of the Community Development Director, who may approve <br />administratively or direct to the Board of Zoning Adjustments for a formal public <br />hearing as a modification to the use permit. <br />B. This conditional use permit is specific to Brooks Motor Cars of San Leandro and <br />is not transferable to another DMV licensed Vehicle Retail Sales dealer. <br />C. Any modification to the display area or number of vehicles for display shall be <br />subject to the review and approval of the Community Development Director who <br />may approve the request or direct the matter to the Board of Zoning Adjustments. <br />D. No wrecked vehicles may be stored on the property. No salvage of vehicle parts <br />shall be conducted on the property. <br />E. The hours shall be restricted to 9 a.m. to 5 p.m., Monday through Friday. Any <br />modification to the hours shall be subject to the review and approval of the <br />Community Development Director who may approve the request or direct the <br />matter to the Board of Zoning Adjustments. <br />Agreement to Conditions July 21, 2005 <br />PLN2005-00057 Page 3 of 5 <br />
