CONDITIONS OF APPROVAL <br />PLN2005-00076 <br />2862 Darius Way <br />Aureliano Gomes (Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The applicant/property owner shall comply with Exhibit A and B dated September <br />6, 2005, except as hereinafter modified. (Exhibits are on file in the City of San <br />Leandro Community Development Department, 835 East 14th Street, San Leandro, <br />California, 94577). <br />Exhibit A -Site Plan <br />Exhibit B -Scale for Fence Modification Heights <br />B. The applicant/property owner shall be responsible for assuring that any successor in <br />interest who assumes responsibility for this zoning approval is informed of its terms <br />and conditions. <br />C. This fence modification approval permits a stucco wall and two vehicle gates <br />taller than three feet within the 10-foot street side yard setback, where three feet is <br />the maximum permitted, at 2862 Darius Way, Alameda County Assessor's Parcel <br />Number 79-20-49. <br />D. The actual height of the stucco wall and the gates will comply with the Exhibit B <br />height scale. <br />E. No later than 30 days after the approval (October 6, 2005) the applicant/property <br />owner shall submit a new, modified, site plan showing: <br />1. The exact location of all sections of the wall and gates and their proximity to <br />the property line; <br />2. The exact height of all sections of the wall and gates; <br />3. Compliance with the driveway vision triangle for the rear portion of the wall <br />where it abuts the adjacent undeveloped lot. <br />F. No later than 60 days after the approval (November 6, 2005), work shall be <br />completed to the wall and gates which brings the height into compliance with the <br />approved modified site plan. <br />G. Landscaping of the area between the public right of way and the wall shall be <br />continued in those areas where the wall is moved back as necessary to comply <br />with Exhibit B. <br />Agreement to Conditions September 6, 2005 <br />PLN2005-00076 Page 3 of 4 <br />
