The subject <br />properties are zoned RD Residential Duplex District and both are only 40 feet wide. Pursuant to Zoning <br />Code Section 4-1650 A., a conditional use permit is required to construct a duplex on substandard lots of <br />40 feet in width where the minimum required is 50 feet for interior lots. Pursuant to Zoning Code <br />Sections 5-2502 B. 1. a. and d., a Site Plan Review (Design Review) is required where additional <br />dwelling units and second-story structures are proposed in the RD District. In addition, pursuant to <br />Zoning Code Section 5-2424, a conditional use permit is required to convert the proposed duplex on each <br />parcel in to a condominium for sale as individual units. Alameda County Assessor's Parcel Number 75- <br />115-40 and 75-115-41. <br />NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Code, it is <br />mutually agreed as follows: <br />1. Applicant agrees to comply with the Conditions of Approval adopted by the City of San <br />Leandro Board of Zoning Adjustments, more specifically described in the list of Conditions of <br />Approval, attached hereto, and as described in the exhibits on file in the Community Development <br />Department, all of which are incorporated herein by this reference. <br />2.
