CONDITIONS OF APPROVAL <br />PLN2005-00138 (15555 East 14th StreetBay Fair Center) <br />APN 77D-1490-16-12 <br />Bay Fair Development, LLC (Applicant and Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The project shall comply with Exhibits A through G, dated April 19, 2006, except as <br />hereinafter modified. (Exhibits are on file at the City of San Leandro, Community <br />Development Department, 835 East 14th Street, San Leandro, California, 94577). <br />Exhibit A -Cover Sheet (Sheet 1) <br />Exhibit B -Partial Site Plan (Sheet 2) <br />Exhibit C -Landscape and Paving Plan (Sheet 3) <br />Exhibit D -Floor Plan (Sheet 4) <br />Exhibit E -Elevations (Sheet 5) <br />Exhibit F -Color and Materials Board <br />Exhibit G -Interior Mall Elevations (supercedes interior elevations in Sheet 5) <br />B. The applicant shall be responsible for assuring that any successor in interest who. <br />assumes responsibility for this zoning approval is informed of its teams and <br />conditions. <br />C. Construction shall commence within one (1) year following Zoning Enforcement <br />Official approval and shall be substantially completed one (1) year thereafter. For <br />the purpose of compliance with this condition, commencement of construction shall <br />be defined as the pouring or construction of a substantial portion of the building <br />foundation. <br />II. PERMITTED USE <br />A. This Site Plan Review is an approval to renovate existing mall space (former Long's <br />Drugs and liner retail spaces) to create a new Old Navy store (16,800 s.£) and <br />approximately 11,700 square feet of small tenant space for approximately 8 shops <br />and/or restaurants at 15555 East 14th Street (Bayfair Mall); Assessor's Parcel <br />Number 77D-1490-16-12. <br />B. Building design, materials, and colors shall remain in substantial compliance with the <br />approved exhibits and plans. Any change to the building design, materials or colors <br />shall be subject to the review and approval of the Zoning Enforcement Official or <br />Community Development Director who may administratively approve the changes, <br />or may refer the matter to the Site Development Sub-Commission. <br />Agreement to Conditions April 19, 2006 <br />PLN2005-00138 Page 3 of 3 <br />
