Ordinance Amendment Chapter 4-5, Title 4 2 November 27, 2007 <br />c. Food Peddlers are no longer permitted in the Shoreline Recreation Area (Marina); <br />and <br />d. Pushcarts, handcarts or dollies are not permitted in the City of San Leandro. <br />3. Finally, the Ordinance adds new clarifying definitions to various terms and references <br />used in the current policy such as: <br />a. Pushcart that is a piece of vending equipment easily moved by a person and <br />prohibited in the City of San Leandro; <br />b. Ice Cream Trucks which are permitted in the City of San Leandro must adhere <br />to the California Vehicle Code (CVC); <br />c. Trailer anon-motorized vehicle that is attached to a motorized vehicle and <br />allowed in the City of San Leandro, must also adhere to the CVC; <br />d. Ice Cream Peddler selling the frozen or refrigerated desserts/confections; <br />e. Handcart is a cart drawn or pushed by hand and prohibited in the City of San <br />Leandro; and <br />f. Dolly is a platform on rollers, wheels or coasters to move objects not allowed for <br />vending purposes in the City of San Leandro. <br />4. Concerns were raised about the $1 million insurance requirement for Peddlers. Upon <br />further review, this requirement has been in effect for over twenty years and has not <br />prevented Peddlers from conducting business in the City of San Leandro. Furthermore, <br />this insurance requirement is consistent with other Bay Area Cities protocol. Currently <br />we have 36 peddlers in the City that have successfully attained adequate insurance. <br />These proposed changes for PSIM's will ensure that the practice of enforcing administrative <br />policy are now stipulated in the Ordinance, definitions are clarified, and additional restrictions <br />are identified for business to be conducted in the City of San Leandro. <br />Current City Council Policy <br />The current City Council policy is to adhere to the current Ordinance Chapter 4-5, Title 4. <br />Previous City Council Action(s) <br />Ordinance Chapter 4-5, Title 4, Article 2 -Legislative History: Ordinance No. 86-026, 8/4/86. <br />City Council Committee Review and Action <br />City Council Finance Committee reviewed and recommended adoption by the City Council ~on <br />October 16, 2007. <br />Applicable General Plan Policy <br />N/A <br />Permits and/or Variances Granted <br />N/A <br />Environmental Review <br />N/A <br />Code Compliance Review <br />N/A <br />
