Jordan & McDonalds Corp. (applicant) <br />Franchise Realty (property owner) <br />THIS AGREEMENT is entered into by and between the CITY OF SAN LEANDRO, a municipal <br />corporation, hereinafter referred to as "City," and P. Jordan, an Individual for McDonald's <br />Corporation, hereinafter referred to as "applicant" and Franchise Realty Inc., hereinafter referred to <br />as "property owner". <br />Applicant applied for and received approval of a Conditional Use Permit to allow a second, <br />additional drive-thru lane adjacent to the existing drive-thru lane, and to modify the restaurant <br />hours to open one-hour earlier, at 5 a.m. instead of 6 a.m., at 14832 East 141h Street. The drive- <br />thru hours were modified to require closing at 11 p.m. Sundays thru Thursdays and at 1 a.m. on <br />Fridays and Saturdays, and to open no earlier than 5 a.m. Assessor's Parcel Numbers 77D-1475- <br />27-1 and 77D-1475-28-1. <br />NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Code, it is <br />mutually agreed as follows: <br />1. Applicant agrees to comply with the Conditions of Approval adopted by the City of San <br />Leandro Board of Zoning Adjustments, more specifically described in the list of Conditions of <br />Approval, attached hereto, and as described in the exhibits on file in the Community Development <br />Department, all of which are incorporated herein by this reference. <br />2. This agreement shall be binding upon and inure to the benefit of the parties hereto and <br />their respective heirs, successors, and assigns. <br />3. City is authorized to record this agreement and any amendments thereto with the <br />Alameda County Recorder, California. All amendments hereto must be in writing and signed by <br />the appropriate authorities of the City and Applicant. The Applicant will be charged the costs of <br />recordation and agrees to pay same.
