<br />THIS AGREEMENT is entered into by and between the CITY OF SAN LEANDRO, a
<br />municipal corporation, hereinafter referred to as "City," and J B East Bay Development
<br />Corporation, a California Corporation, hereinafter referred to as "Applicant," and
<br />Washingtol~/Springlake Properties, LLC, a California Limited Liability Company, hereinafter
<br />referred to as "Property Owners."
<br />Applicant has received approval for a General Plan Map Amendment, Rezoning, Planned
<br />Development, and Vesting Tentative Map; General Plan Map Amendment from Low Density
<br />and General Commercial designation to Medium Density Residential; Rezone from RS
<br />Residential Single Family and CC Community Commercial to RM3000(PD) Residentia] Multi-
<br />Family, Planned Development Overlay District, Planned Development to construct a 43-unit
<br />residential development, Vesting Tentative Map, Tract No. 7579 to subdivide the subject
<br />property; 14953, 14969, 14981-14985 Washington Avenue (Adjacent to the Interstate 880
<br />Freeway and opposite Springlake Drive); Alameda County Assessor's Parcel Nos. 77B-1120-1-1,
<br />77B-1120-4, 77B-1120-5, and 77B-1120-6.
<br />NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Code, it is
<br />mutually agreed as follows:
<br />1. Applicant agrees to comply with the Conditions of Approval adopted by the City of San
<br />Leandro City Council, more specifically described in the list of Conditions of Approval, attached
