IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2007-155 (3069) <br />RESOLUTION INITIALLY ACCEPTING SUBDIVISION IMPROVEMENT WORK <br />FOR TRACT 7659 LOCATED AT 635 AND 641 MACARTHUR BOULEVARD; <br />DEVELOPER: SUPERIOR MACARTHUR, LLC <br />Recitals <br />Pursuant to a Subdivision Improvement Agreement between the City of San Leandro and <br />Superior MacArthur, LLC, dated May 15, 2006, and associated plans identified as Tract 7659, <br />certain subdivision improvement work has been completed. <br />Said work has been completed in accordance with the plans and specifications therefore <br />and to the satisfaction of the Engineering and Transportation Director, and he therefore <br />recommends that said work be accepted. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />1. That the work hereinbefore described is hereby accepted. <br />2. That the bonds heretofore given for performance and payment of said conditions <br />are hereby discharged and exonerated from further liability. <br />3. That upon completion to the satisfaction of the Engineering and Transportation <br />Director of the one-year Maintenance Period established pursuant to said contract, <br />the City Manager is hereby authorized to release the bond heretofore given for <br />maintenance of the work hereinbefore described. <br />Introduced by Councilmember Prola and passed and adopted this 17th day of December <br />2007, by the following called vote: <br />Members of the Council: <br />AYES: Councilmembers Gregory, Prola, Souza, Starosciak, Stephens; Mayor Santos (6) <br />NOES: None ~~) <br />ABSENT: Councilmember Grant (I) <br />ATTEST: ~~~~-~ <br />Marian Handa, City Clerk <br />
