IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2008-001 (1007/2925) <br />RESOLUTION SUMMARILY VACATING PORTIONS OF THE EMERGENCY VEHICLE <br />ACCESS EASEMENT, INGRESS AND EGRESS EASEMENT, AND PUBLIC UTILITY <br />EASEMENT ACROSS NEW LOT 8 OF TRACT 7382, 1400 BUSINESS CENTER DRIVE, <br />SAN LEANDRO, ASSESSOR'S PARCEL NO. 079A-0591-015 <br />RECITALS <br />WHEREAS, the portions of the easements to be summarily vacated by this resolution are <br />located within the vicinity of the cul-de-sac at the southern end of Business Center Drive as <br />shown on the map of Tract 7382 and are more precisely described in Exhibits BBC-B, BBC-G, <br />BBC-H, BBC-J, and accompanying plats, attached hereto, and made a part hereof; and <br />WHEREAS, the subject portions of land are no longer required for emergency vehicle <br />access purposes, ingress and egress purposes, or public utility purposes since said cul-de-sac has <br />been relocated with the recordation of a lot line adjustment on July 17, 2007 as Instrument No. <br />2007-261221, Alameda County Official Records; and <br />WHEREAS, the proposed vacation has been found to be categorically exempt from the <br />California Environmental Quality Act; and <br />WHEREAS, said summary vacation is made under Chapter 4 (Summary Vacation), Part <br />3, Division 9, Section 8333(b), of the California Streets and Highway Code. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That the City Council hereby orders the summary vacation of the herein above <br />described Emergency Vehicle Access Easement, Ingress and Egress Easement, and <br />Public Utility Easement. <br />2. That the City Clerk shall cause a certified copy of this resolution to be recorded in the <br />Office of the Recorder of Alameda County, California, immediately upon its <br />adoption. <br />That from and after the date of recordation of this resolution, said portions of land no <br />longer constitute public service easements. <br />Introduced by Councilmember Stephens and passed and adopted this 7`h day of January <br />2008, by the following called vote: <br />
