WHEREAS City and Agency staff, San Francisco Bay Area Rapid Transit District (BART), <br />and Westlake Development Partners, LLC have negotiated an Exclusive Negotiating Agreement, <br />under which Westlake Development Partners, LLC would further investigate site conditions and <br />development possibilities, eventually leading to some form of development agreement to be <br />determined, between the City, Agency and Westlake Development Partners, LLC; and <br />WHEREAS in the interest of insuring broad public participation in a project application that <br />will result from this Exclusive Negotiating Agreement, community groups, organizations and <br />various stakeholders will be provided an opportunity to address the following issues, including, but <br />not limited to: <br />• child care and social services, <br />• affordable housing, <br />• sustainability and green building, <br />• information on impacts to neighborhoods, and <br />• employment generation during construction and at build-out; and <br />WHEREAS the Agency has been presented with the Exclusive Negotiating Agreement and <br />is familiar with the contents thereof; <br />NOW, THEREFORE, the City of San Leandro does RESOLVE as follows: <br />That the Exclusive Negotiating Agreement with Bay Area Rapid Transit District (BART) <br />and Westlake Development Partners, LLC is hereby approved, and the City Manager is authorized <br />to execute it. <br />Introduced by Councilmember and passed and adopted this <br />4th day of February, 2008 by the following called vote: <br />Members of the City Council: <br />AYES: <br />NOES <br />ABSENT: <br />ATTEST: <br />Marian Handa, City Clerk <br />
