The proposed use <br />is not a permitted or conditionally permitted use in the underlying zoning district, which is IP <br />Industrial Park. Therefore, the Board of Zoning Adjustments denied the Conditional Use <br />Permit application. <br />• The applicants appealed the Board of Zoning Adjustments denial of the conditional use <br />permit and determination that the proposed use is an assembly use under the San Leandro <br />Zoning Code. <br />• Staff recommends that the City Council uphold the Board of Zoning Adjustments <br />determination and make the necessary findings to deny the appeal and deny application <br />PLN2007-00013. <br />• The primary proposed use meets the San Leandro Zoning Code definition of "assembly use," <br />found at Section 1-304 and said use is not a permitted or conditionally permitted use in the IP <br />District. <br />
