Build upon the locational strengths and transportation <br />features of West San Leandro to support the area's continued development as a major <br />industrial, technology, and office employment center. In accordance with the West San <br />Leandro Plan, limit the encroachment of incompatible residential and retail uses in to the <br />area, and promote additional development and redevelopment with manufacturing, <br />technology, warehouse and distribution, office/flex, and similar uses. <br />This proposal is inconsistent with this policy because an assembly use would inhibit existing and <br />proposed industrial uses; uses which frequently utilize heavy trucks with around-the-clock <br />operations. <br />General Plan Policy 10.04 states the following: <br />• Industrial Sanctuary. Protect the City's major industrial areas from encroachment by uses <br />that are potentially incompatible with existing viable industrial activities, or which may <br />inhibit the ability of industry to operate effectively. <br />This inconsistency is self evident in that assembly uses introduce sensitive receptors in an <br />industrial setting, thereby inhibiting the operation of industrial uses. <br />General Plan Policy 13.01 states the following: <br />• Decision -Making. Ensure that future land use and development decisions are in balance with <br />the capacity of the City's transportation system. <br />Each of these General Plan policies identifies the importance of a cohesive, functioning industrial <br />district in the City of San Leandro and more particularly in the West San Leandro Business <br />District in which the property is located. These policies also recognize the disruption that <br />incompatible land uses could cause in the continued effectiveness of San Leandro's industrial <br />base. Denial of the conditional use permit is consistent with limiting the encroachment of <br />incompatible uses in the industrial area. <br />Permits and/or Variances Granted <br />Not applicable. <br />Environmental Review <br />If — and only if — the City Council denies the appeal and therefore the application, the matter is <br />statutorily exempt from the California Environmental Quality Act (CEQA) per CEQA Guidelines, <br />Article 18, Statutory Exemptions, Section 15270, "Projects Which Are Disapproved." That <br />guideline provides that CEQA does not apply to projects which a public agency rejects or <br />disapproves. Staff advises, however, that should the City Council disagree with the staff and Board <br />of Zoning Adjustment's recommendation and wish to consider approving the application, <br />additional environmental impact analysis would first be required. The City Council would <br />therefore need to direct staff to prepare an Initial Study, which would result in the preparation of <br />either a Negative Declaration or an Environmental Impact Report.
