DRAFT MINUTES Page 3 February 4, 2008 City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting 10. ACTION ITEMS A. Matter of an Exclusive Negotiating Agreement Between the City of San Leandro, the Redevelopment Agency of the City of San Leandro, San Francisco Bay Area Rapid Transit District (BART) and Westlake Development Partners, LLC (provides for negotiating terms relating a transit-oriented, mixed-use development located on multiple parcels adjacent to the San Leandro BART Station). Assistant City Manager Hollister gave background on the matter. He pointed out that the City Council resolution was modified to list certain social activities that should be discussed with the community, labor and other interest groups during the negotiations, and the Redevelopment Agency (RDA) resolution could be similarly modified. Mr. Hollister commented that these groups are in agreement that the Council needs to approve the Exclusive Negotiating Agreement (ENA) tonight, as the approval of the agreement is necessary in order to the file applications for Metropolitan Transportation Commission (MTC) and Prop 1C grant funds. Community Development Director Luke Sims provided additional background on the ENA and the involvement by the City and Redevelopment Agency. Mr. Sims described the ENA process in defining the project, and he indicated that the process would have a timeframe of approximately 18 months. He reported that the BART Board of Directors approved the ENA on January 24, 2008. Planning Manager Kathleen Livermore stated that the ENA is a result of the Transit- Oriented Development (TOD) Strategy adopted by the Council in September 2007. She described the parcels that comprised the subject area, Special Policy Area A, the area around the BART parking lot. Ms. Livermore stated that the ENA allows all the parties to pursue discussion of potential development. She acknowledged the BART representatives who were in the audience. Public Comments on Item 10.A.: Barry Luboviski, Building & Construction Trades Council of Alameda County, addressed the City Council on behalf the Labor and Community Coalition, comprised of the Building Trades and Congregations Organizing for Renewal (COR), which is working to promote housing for working families. Mr. Luboviski expressed support for the ENA and the TOD process. Mr. Luboviski commented that as part of the process, early dialogue is helpful to those negotiating the agreement by identifying issues early on. Anthony Martinez, representing COR , addressed the City Council, commenting on for its work on the TOD Strategy. He commented that COR participated in the TOD Citizen Advisory Committee (CAC) and community meetings and hosted its own TOD community forum. Mr. Martinez commented on the need for dialogue between developers and community members in the development of a project. Mr. Martinez expressed support for the ENA and the TOD vision.
