gaining access to the leased premises during the period <br />suchinsurance policies are not in full force and effect. <br />8.4 Waiver of Subrogation <br />Landlord and Tenant each hereby waive any and all <br />rights of recovery against the other, or against the officers, <br />employees, agents and representatives of the other, for loss of <br />or damage to such waiving party or its property or the property <br />of others under its control to the extend that such loss or <br />damage is insured against under any insurance policy in force at <br />the time of such loss or damages. The insuring party shall upon <br />obtaining the policies of insurance required hereunder, give <br />notice to the insurance carrier or carriers that the foregoing <br />mutual waiver of subrogation ~s contained in the Lease. <br />ARTICLE 9. PAYMENT OF TAXES <br />Tenant agrees to pay and discharge, or cause to be paid <br />and discharged when due, before the same become delinquent, all <br />taxes, assessments, impositions, levies and charges of every <br />kind, nature and description, whether general or special, <br />ordinary or extraordinary, which may directly or indirectly, be <br />taxed, levied, charged, assessed or imposed upon or against, or <br />which shall be or may be or become a lien upon said premises or <br />any buldings, improvements or structures at any time located <br />thereon, or any estate, right, title or interest of Tenant in and <br />to said premises, buildings, improvements or structures. Tenant <br />shall pay when due, before delinquency, personal property taxes <br />on fixtures, equipment and facilities owned by Tenant, whether or <br /> <br />part of the real estate.
