conditions or covenants specified herein. Landlord further <br />reserves the right of entry by any authorized officer, engineer, <br />employee, contractor or agent of the Landlord for the purpose of <br />performing any maintenance activities upon the property which <br />Tenant has failed to perform. <br />ARTICLE 11. CONbEMNATION <br />11.1 Termination of Lease as to Part Condemned <br />In the event the whole or any part of the premises is <br />condemned by a public entity in the lawful exercise of the power <br />of eminent domain, this lease shall cease as to the part <br />condemned upon the date possession of that-part is taken by the <br />public entity. In the event it becomes necessary for Landlord to <br />acquire the whole or any part of the premises for a <br />transportation-related public use, Tenant hereby specifically <br />waives all objections to Landlord's right to take; and the only <br />issue to be resolved in any condemnation action shall be the <br />amount of compensation to which Tenant is entitled under <br />paragraph 11.5. <br />11.2 Nonsubstantial Taking <br />If only a part is condemned and the taking of that part <br />does not substantially impair the capacity of the remainder to be <br />used for the purposew requried in this Lease, Tenant shall <br />continue to be bound by the terms, covenants, and conditions of <br />this Lease; provided, however, that if the fair rental value of <br />the remainder will be less than the rent required by this Lease, <br />the minimum monthly rent and adjusted minimum monthly rent shall <br />-14- <br />
