Landlord shall be entitled to receive and shall receive <br />all compensation for the condemnation of all .or any portion of <br />the premises by exercise of eminent domain .except as hereinafter <br />provided. Tenant shall be entitled to that portion of said <br />compensation which represents the present worth as of the date <br />possession is taken by the public entity of the remaining use <br />under the Lease of all improvements constructed by Tenant on the <br />leased premises located within the part taken by the public <br />entity. <br />Tenant shall assert no claim for loss of bonus value. <br />For the purpose of this article, "bonus value" means that value <br />attributable to the fact that the rental rate tenant is obligated <br />to pay' under this Lease is less than the fair market lease rate <br />of the premises. <br />If all or a portion of the leased premises is condemned <br />at a time when Tenant possesses an interest in real property <br />located outside the leased premises (hereinafter called "outside <br />property"), Tenant shall not be entitled to any compensation <br />otherwise accruing to the outside property by reason of the <br />severance therefrom of the condemned portion of the leased <br />premises. <br />ARTICLE 12. UTILITIES <br />Tenant shall pay prior to delinquency for all water, <br />gas, heat, light, power, telephone, sewage, air conditioning and <br />ventilating, scavenger, janitorial and landscaping services and <br />all other materials and utilities supplied to the premises. <br />Landlord shall not be liable in damages or otherwise for any <br />-16- <br />
