CONDITIONS OF APPROVAL <br />PLN2007-00053 <br />2453 Harborview Drive <br />Brian Libow (Applicant and Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The applicant/property owner shall comply with Exhibits A through C, attached to the staff <br />repoi~ dated October 16, ?007, except as hereinafter modified. (Exhibits are on file in the City <br />of San Leandro Community Development Department, 835 East 14th Street, San Leandro, <br />California, 94577). <br />Exhibit A: Site Plan, Including Adjacent Dwelling <br />Exhibit B: Floor Plans <br />Exhibit C: Elevations and Roof Plan <br />B. The applicant/property owner shall be responsible for assuring that any successor in interest <br />who assumes responsibihity for this zoning approval is informed of its terms and conditions. <br />C. Construction shall commence within one (1) year following Zoning EnForcement Official <br />approval of the Major View Preservation/Site Plan Review and shall be substantially <br />completed one year after commencement of construction. For the purpose of compliance <br />with this condition, commencement of construction shall be defined as the construction of <br />a substantial portion of the building foundation structures. <br />D. This Major View Preservation/Site Plan Review approval permits the construction of a <br />one-story addition to the rear and front of the existing one-story dwelling and will result in <br />a total of approximately 538 square feet of new living area being added to the existing <br />2,679 square feet of livable space, at 2453 Harborview Drive, Alameda County Assessor's <br />Parcel Number 79-27-19. <br />E. The subject residence shall be limited to single-family occupancy, only, unless the City <br />grants approval of a permit for any other unit. For the purposes of this condition, <br />installation of any appliances for cooking, including, but not limited to a stove, hot plate or <br />microwave oven, in any room other than the individual kitchen in the existing dwelling <br />unit within the single-family home, shall be deemed the creation of an additional kitchen <br />and therefore creation of an additional dwelling unit. Specifically, bedrooms or any room <br />other than the designated kitchen in the home on the property shall not have any other <br />kitchen and shall not be acknowledged as a separate dwelling unit at the subject property. <br />F. Pursuant to Zoning Code Section 2-520 (Maximum Dwelling Unit Occupancy), a zoning <br />permit shall be required for occupancy of a dwelling unit by more than ten (10) persons <br />eighteen (18) years or older. <br />Agreement to Conditions October 16, 2007 <br />PLN2007-0O053 Page 3 of4 <br />
