RECOMMENDED <br />FINDINGS OF FACT FOR APPROVAL OF <br />PLN2006-00059 <br />235 Haas Avenue (Woodside Apartments Complex) <br />Alameda County Assessor's Parcel Number 76-437-7-1 <br />K. Oesterreich, Davidon Investors (applicant and property owner) <br />Condominium Conversion Use Permit Findings <br />A. That the proposed location of the use is in accord with the objectives of this Cade and <br />the purposes of the district in which the site is located. <br />The creation of the condominium for separate ownership of the 96 apartment units is in <br />accord with the RM-1800 Residential Multi-Family District purposes and requirements. <br />The purpose and requirements of the RM District is to pmvide opportunities for multiple <br />residential uses such as townhouses, condominiums, multi-dwelling structures, or cluster <br />housing with landscaped open space for residents' use. <br />B. That the proposed location of the use and the proposed conditions under which it <br />would be operated or maintained will be consistent with the General Plan; will not be <br />detrimental to the public health, safety or welfare of persons residing or working in or <br />adjacent to the neighborhood of such use; and will not be detrimental to properties or <br />!, improvements in the vicinity or to the general welfare of the City. <br />The proposal will attain the General Plan's Policies 3.01-Mix of Unit Types, 53.03- <br />Inclusionary Housing, and 56.08-Condominium Conversion: <br />Policy 3.01- Mix of Unit Types Encourage a mix of residential development types <br />in the City, including single-family homes on a variety of lot sizes, as well as <br />townhomes, row houses, live-work units, planned unit developments, and multi- <br />family housing. <br />Policy 53.03 - Inclusionary Housing Require the inclusion of affordable housing <br />in new housing developments-both inside and outside of redevelopment project <br />areas. Modify existing inclusionary housing ordinances as needed to make these <br />requirements clearer and more effective. <br />Po'cy 56.08 -Condominium Conversion Allow apartments to be converted to <br />condominiums or cooperatives only where the following conditions exist: <br />• A tenant relocation plan is provided. <br />• The design of the building is appropriate for a wide range of residents. <br />j j • Obsolete or inappropriately designed aspects of the building can be replaced <br />or raised to current standards. <br />Discourage conversions which would result in a net loss of affordable units or the <br />;~ <br />displacement of low income tenants. <br />
