CITY OF SAN LEANDRO/ <br />REDEVELOPMENT AGENCY <br />STAFF REPORT <br />DATE: March 17, 2008 <br />TO: John Jermanis, City Manager and <br />Executive Director <br />APPROVED AND <br />FORWARDED <br />TO THE CITY COUNCIL AND <br />REDEVELOPMENT AGENCY <br />Jo .- ermanis <br />anager and Executive <br />Director <br />FROM: Luke Sims, Community Development Director~j <br />~'~,~. <br />BY: Kathleen Livermor Panning Manager <br />SUBJECT/PROJECT DESCRIPTION <br />MATTER OF AN ADDENDUM TO THE EXCLUSIVE NEGOTIATING AGREEMENT <br />(ENA) BETWEEN THE CITY OF SAN LEANDRO, THE SAN LEANDRO <br />REDEVELOPMENT AGENCY, SAN FRANCISCO BAY AREA RAPID TRANSIT (BART) <br />AND WESTLAKE DEVELOPMENT PARTNERS, LLC <br />SUMMARY AND RECOMMENDATION <br />Staff recommends that the City Council adopt the resolution authorizing an Addendum to the <br />Exclusive Negotiating Agreement with San Francisco Bay Area Rapid Transit (BART) and <br />Westlake Development Partners, LLC and that the Redevelopment Agency of the City of San <br />Leandro adopt the resolution authorizing an Addendum to the Exclusive Negotiating Agreement <br />with San Francisco Bay Area Rapid Transit (BART) and Westlake Development Partners, LLC. <br />Resolutions authorizing the signing of an Exclusive Negotiating Agreement with BART and <br />Westlake Development Partners, LLC were approved by the City Council and Redevelopment <br />Agency at the February 4, 2008 City Council meeting. A question arose concerning civic <br />engagement and the Addendum was prepared to address this concern. <br />BACKGROUND <br />At the February 4, 2008 City Council meeting, a question arose concerning civic engagement in <br />providing input on the development application during the term of the Exclusive Negotiating <br />Agreement (ENA). The question was directed to the Business Development and Housing <br />Committee for further discussion and review. At the February 14, 2008 Business Development <br />and Housing Committee, language to address public participation during the term of the ENA <br />was presented by staff and refined by the Committee, following input during the public <br />comments portion of the meeting. At the March 3, 2008 City Council meeting, the Council <br />directed staff to prepare an Addendum to address the civic engagement process. <br />
