IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2008-027 (3132) <br />RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO SIGN AND <br />FILE, FOR AND ON BEHALF OF THE CITY OF SAN LEANDRO, A CAL/EPA GRANT <br />APPLICATION TO IMPLEMENT THE ABOVEGROUND PETROLEUM STORAGE ACT <br />(APSA) ANDAN AGREEMENT WITH CAL/EPA ACCEPTING DELEGATION AND <br />AGREEING TO IMPLEMENT THE APSA <br />WHEREAS, the City of San Leandro has been certified by the Secretary for <br />Environmental Protection as a Certified Unified Program Agency ("CUPA"); and <br />WHEREAS, pursuant to Health and Safety Code Section 25270.11, the California <br />Environmental Protection Agency has established the Environmental Protection Trust Fund to <br />implement the requirements of the Aboveground Petroleum Storage Act; and <br />WHEREAS, the City CUPA desires to submit an application for grant funds available <br />from the Environmental Protection Trust Fund; and <br />WHEREAS, in the event the San Leandro CUPA is awarded a grant from the <br />Environmental Protection Trust Fund, the City will be required to enter into a grant agreement <br />which governs the disbursement and use of the grant funds; and <br />WHEREAS, if the San Leandro CUPA is awarded a grant from the California <br />Environmental Protection Agency, the San Leandro CUPA shall use these grant funds in a <br />manner consistent with the grant agreement, and any amendment thereto, to implement the <br />requirements of the Aboveground Petroleum Storage Act. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />1. The City Council authorizes the City Manager to submit a grant application to the <br />California Environmental Protection Agency for a grant from the California Environmental <br />Protection Trust Fund. <br />2. The City Manager, or his designee, is hereby authorized and empowered to <br />execute in the name of the City of San Leandro all necessary applications, contracts, agreements, <br />and amendments thereto for the purposes of securing grant funds to implement and carry out the <br />Aboveground Petroleum Storage Act. <br />Introduced by Councilmember Starosciak and passed and adopted this 17th day of March, <br />2008, by the following called vote: <br />
